Procedure for Access and Benefit Sharing out of Commercial Utilization of Bioresources

The Biological Diversity Act 2002 and Rules 2004 by Government of India is a landmark legislation which provides for regulated access to bio resources for commercial utilization or for bio-survey and bio-utilization. The effective implementation of Access and Benefit Sharing (ABS) provisions in the territorial jurisdiction of India is dealt with in the Sections 3, 4, 5, 6 and 7 of Biological Diversity Act 2002  and Section 16 of Kerala Biological Diversity Rules 2008.

Approval For access to bioresources for commercial utilization by Indian citizens

Form I

Form A

The applications received in prescribed format as per BD Act are processed according to a Standard operating procedure Signing of agreement for equitable sharing of benefits.

The applications will be processed within 90 days of receipt

Rs 1000/-

Approval for access to bioresources for commercial utilization by non Indians

 

The applications in Form I to be submitted to NBA on line which will be forwarded to SBB for approval by BMC

The applications will be processed within 30 days of receipt

 
Applying for Intellectual Property Rights for inventions based on any research on a biological resource obtained from India  

The applications in Form III to be submitted to NBA on line which will be forwarded to SBB for approval by BMC
